The recent case of the Delhi gang-rape has sparked a lot of protests throughout India. This, ofcousre, is not the only incident of rape in India. There have been many more cases reported, and infact it is reported that the crime of rape and sexual assault against women has increased recently. But, as we stand together against this heinous crime against women, the question that arises is, what is the solution to this problem, which is so prevalent in our society?
Islam offers a three way solution to this problem
- God consciousness. The society should have the consciousness of God and fear of disobeying Him. They should know that God has power over all things and they they will be accountable to Him. They should know that even if they are able to escape the punishment in this life, they will not be able to get away from the punishment of God, which will be severe indeed.
God says in the Quran
“O you who believe! Have consciousness of God, as you should have of Him and do not die except as Muslims.” [Quran3:102]
if you do good, you will do good for your own souls; and if you do evil, it will be to your own loss. [Quran 17:70]
As to those who reject Faith,- if they had everything on earth, and twice repeated, to give as ransom for the penalty of the Day of Judgment, it would never be accepted of them, theirs would be a grievous penalty. [Quran 5:36]
God is never unjust in the least degree [Quran 4:40]
Those who reject our Signs, We shall soon cast into the Fire: as often as their skins are roasted through, We shall change them for fresh skins, that they may taste the penalty: for God is Exalted in Power, Wise. [Quran 4:56]
2. Obey God’s commandments. People should be encouraged to obey God’s commandments. They should maintain a modesty level as God has commanded
Narrated by Abu Huraira (ra): The Prophet said, “Faith (Belief) consists of more than sixty branches (i.e. parts). And Haya (modesty, shyness) is a part of faith.” (Bukhari)
God, in the Quran, commands both men and women to maintain their modesty.
Say to the believing men that they should lower their gaze and guard their modesty: that will make for greater purity for them: And God is well acquainted with all that they do. [Quran 24:30]
Men are commanded to lower their gaze. They should not stare at women who are not related to them. They should not watch movies and other programs that have women who are immodestly dressed.
And say to the believing women that they should lower their gaze and guard their modesty; that they should not display their beauty and ornaments except what (must ordinarily) appear thereof; that they should draw their veils over their bosoms and not display their beauty except to their husbands, their fathers, their husband’s fathers, their sons, their husbands’ sons, their brothers or their brothers’ sons, or their sisters’ sons, or their women, or the slaves whom their right hands possess, or male servants free of physical needs, or small children who have no sense of the shame of sex; and that they should not strike their feet in order to draw attention to their hidden ornaments. And O ye Believers! turn ye all together towards God, that ye may attain Bliss. [Quran 24:31]
O Prophet! Tell thy wives and daughters, and the believing women, that they should cast their outer garments over their persons (when abroad): that is most convenient, that they should be known (as such) and not molested. And God is Oft-Forgiving, Most Merciful. [Quran 33:59]
This ofcourse does not mean that if a woman is not properly dressed, then she can be molested or raped. Infact, the previous verse commanded men to not even stare at women, let alone touch her. The man who goes on to molest or rape a woman has done a heinous crime and is to be blamed irrespective of what the woman was wearing. However, the hijab acts as a protection for women against those men who may not be obeying God’s commands
Let me explain this with an example.Suppose two sisters who are twins, and who are equally beautiful, walk down the street. One of them is attired in the Islamic hijaab i.e. the complete body is covered, except for the face and the hands upto the wrists. The other sister is wearing western clothes, a miniskirt or shorts. Just around the corner there is a hooligan or ruffian who is waiting for a catch, to tease a girl. Whom will he tease? The girl wearing the Islamic Hijaab or the girl wearing the skirt or the mini? Naturally he will tease the girl wearing the skirt or the mini. Its not to say that wearing mini gave men the authority to molest her. But its to show that wearing hijab acts as a preventive measure for the woman,
3. Justice. Under the Islamic Law, a man convicted of having raped a woman, is given capital punishment.
Sunan Abu-Dawud, Book 38:
Narrated Wa’il ibn Hujr:
When a woman went out in the time of the Prophet (peace_be_upon_him) for prayer, a man attacked her and overpowered (raped) her.
She shouted and he went off, and when a man came by, she said: That (man) did such and such to me. And when a company of the Emigrants came by, she said: That man did such and such to me. They went and seized the man whom they thought had had intercourse with her and brought him to her.
She said: Yes, this is he. Then they brought him to the Apostle of Allah (peace_be_upon_him).
When he (the Prophet) was about to pass sentence, the man who (actually) had assaulted her stood up and said: Apostle of Allah, I am the man who did it to her.
He (the Prophet) said to her: Go away, for Allah has forgiven you (for blaming the wrong man). But he told the man some good words (AbuDawud said: meaning the man who was seized), and of the man who had had intercourse with her, he said: Stone him to death.
He also said: He has repented to such an extent that if the people of Medina had repented similarly, it would have been accepted from them.
Note that the prophet did not ask the woman, as to why she went out alone. Infact he ordered that the culprit should be stoned to death.
If these measures are implemented in the society, it will surely lower the crimes of sexual assault and rape against women.
